Preamble

Welcome to WaterHIRD.


WaterHIRD is an independent educational organization dedicated to advancing knowledge, professionalism, leadership, and public service within the water, wastewater, utility, environmental, and related industries.


Our mission extends beyond education. WaterHIRD exists to foster a community of professionals committed to protecting public health, safeguarding the environment, advancing industry knowledge, and strengthening the essential workforce responsible for protecting civilization through water.


These Master Terms of Service & User Agreement ("Agreement") establish the legal relationship between WaterHIRD and every individual or entity who accesses or uses the WaterHIRD platform.


By accessing any WaterHIRD website, course, membership, subscription, digital product, merchandise, educational content, game, forum, community feature, mobile application, social media platform, event, webinar, or related service (collectively, the "Services"), you agree to comply with this Agreement.


If you do not agree with these Terms, you must immediately discontinue use of the Services.


ARTICLE I

Definitions

For purposes of this Agreement, the following terms shall have the meanings set forth below.


1.1 WaterHIRD

"WaterHIRD," "Company," "we," "our," and "us" refer collectively to WaterHIRD, its owner, authorized instructors, contributors, moderators, volunteers, representatives, successors, assigns, contractors, affiliates, and any person or entity expressly authorized to operate on behalf of WaterHIRD.


1.2 Services

"Services" means every product, feature, platform, offering, subscription, educational program, course, certification program, membership, downloadable resource, digital asset, software, application, forum, leaderboard, social media account, game, event, webinar, podcast, merchandise offering, future technology, or other service provided by WaterHIRD.


1.3 User

A "User" means any individual or entity who visits, browses, accesses, registers for, purchases, subscribes to, contributes to, participates in, or otherwise interacts with the Services.


1.4 Educational Content

Educational Content includes all information, lessons, presentations, videos, quizzes, examinations, flashcards, graphics, photographs, audio recordings, podcasts, written materials, study guides, downloadable documents, games, simulations, instructional methods, educational systems, and all other learning materials created, licensed, or distributed by WaterHIRD.


1.5 Platform

The Platform includes every website, learning management system, application, forum, social media account, digital communication channel, marketplace, future application, or technology owned, operated, licensed, or controlled by WaterHIRD.


1.6 Community

The Community refers to all users participating in discussions, forums, comments, events, leaderboards, memberships, social media groups, or any other interactive feature offered by WaterHIRD.


1.7 Intellectual Property

Intellectual Property includes, without limitation, copyrights, trademarks, trade dress, logos, branding, slogans, educational methodologies, business strategies, software, source code, graphics, documents, videos, written works, proprietary processes, confidential information, trade secrets, customer lists, and all other proprietary rights owned or licensed by WaterHIRD.


1.8 Owner

"Owner" refers to the lawful proprietor of WaterHIRD and any successor or legal entity to which ownership may later be transferred.


ARTICLE II

Acceptance Of This Agreement

2.1 Binding Agreement

This Agreement constitutes a legally binding contract between WaterHIRD and every User.


By accessing or using any portion of the Services, Users acknowledge that they have read, understood, and voluntarily agree to be bound by every provision contained herein.


2.2 Methods of Acceptance

Acceptance of this Agreement occurs through any of the following actions:


• Creating a user account.


• Purchasing a course.


• Purchasing merchandise.


• Purchasing a subscription.


• Purchasing a membership.


• Registering for an event.


• Downloading WaterHIRD materials.


• Participating in any course.


• Posting content.


• Joining a community.


• Clicking "Accept," "I Agree," "Continue," or any similar acknowledgement.


• Accessing or using the Services after these Terms have been published.


No handwritten signature is required for this Agreement to become legally enforceable.


2.3 Continuing Acceptance

Each subsequent visit to the Platform constitutes renewed acceptance of this Agreement and any amendments made thereto.


Users who do not agree with any revision shall immediately discontinue use of the Services.


ARTICLE III

Electronic Acceptance And Signature

Users acknowledge that electronic records and electronic signatures carry the same legal effect as handwritten signatures where permitted by applicable law.


By creating an account, completing a purchase, subscribing to a service, or clicking any button indicating acceptance, Users consent to conduct business electronically with WaterHIRD and agree that such actions constitute a legally binding electronic signature.


Users further consent to receive notices, agreements, disclosures, invoices, receipts, policy updates, and other communications electronically unless otherwise required by law.


ARTICLE IV

Eligibility To Use The Services

4.1 Eligibility

The WaterHIRD Services are intended for individuals seeking education, professional development, industry awareness, or community engagement within the water, wastewater, environmental, utility, and related industries.


Unless otherwise permitted by applicable law, Users must be at least eighteen (18) years of age, or the legal age of majority within their jurisdiction, to create an individual account, purchase products or services, enter into a subscription, or otherwise accept this Agreement.


Individuals under the age of eighteen (18) may access certain educational content only with the knowledge, permission, and supervision of a parent, legal guardian, educational institution, or employer, where appropriate.


WaterHIRD reserves the right to request verification of a User's age or eligibility at any time.


4.2 Authority to Enter into this Agreement

By accepting this Agreement, each User represents and warrants that he or she possesses the legal authority and capacity to enter into a binding contract.


If a User is accessing the Services on behalf of a business, employer, governmental agency, educational institution, or other legal entity, the User further represents that he or she has authority to bind that entity to this Agreement.


4.3 Geographic Availability

WaterHIRD intends its educational content to be available internationally; however, Users are solely responsible for determining whether access to or use of the Services complies with the laws, regulations, licensing requirements, export restrictions, and other legal obligations applicable within their jurisdiction.


WaterHIRD makes no representation that any Service is appropriate or legally available in every country, state, province, or locality.


4.4 Right to Refuse Service

To the fullest extent permitted by applicable law, WaterHIRD reserves the right, at its sole discretion, to refuse access to any individual or organization for any lawful business reason.


Nothing contained within this Agreement shall obligate WaterHIRD to provide Services to every applicant or continue providing Services indefinitely.


ARTICLE V

Independent Business Statement

5.1 Independent Organization

WaterHIRD is an independently owned and operated educational business.


The Services are developed, administered, and maintained independently and are not sponsored by, endorsed by, controlled by, operated by, or officially affiliated with any governmental agency, municipality, utility, employer, educational institution, certification board, licensing authority, manufacturer, professional association, or other outside organization unless expressly identified in writing.


5.2 Independence of Educational Content

The educational opinions, instructional methods, demonstrations, discussions, commentary, and learning materials presented through WaterHIRD represent the educational viewpoints of WaterHIRD alone.


Nothing contained within the Services shall be interpreted as the official policy, procedure, recommendation, guidance, engineering standard, legal interpretation, regulatory position, or operational directive of any outside organization.


5.3 Protection of Outside Organizations

WaterHIRD is operated independently from any outside employment, consulting activity, volunteer position, board membership, professional affiliation, governmental service, or organizational relationship maintained by its owner, instructors, moderators, contributors, or representatives.


Accordingly, no outside employer, governmental agency, municipality, utility, educational institution, licensing authority, private company, nonprofit organization, or professional association shall bear any responsibility or liability for:


WaterHIRD's educational content;

WaterHIRD's business operations;

User accounts;

Memberships;

Products;

Services;

Community discussions;

Business decisions;

Customer service;

Platform administration; or

Any dispute arising from the use of the Services.

5.4 Exclusive Contact Requirement

All questions, customer service requests, complaints, legal notices, demands, disputes, refund requests, technical support inquiries, or other communications concerning WaterHIRD shall be directed exclusively to WaterHIRD through its designated communication channels.


Users agree not to contact, involve, pressure, harass, or seek recourse through any unrelated employer, governmental entity, utility, educational institution, licensing authority, client, or affiliated organization concerning matters arising from the Services.


5.5 No Representation of Outside Organizations

Unless expressly authorized in writing, no User shall state or imply that WaterHIRD or its owner, instructors, contributors, moderators, or representatives are acting on behalf of any governmental agency, municipality, employer, utility, licensing authority, educational institution, or other outside organization.


ARTICLE VI

Educational Mission And Purpose

6.1 Mission

WaterHIRD exists to strengthen the knowledge, professionalism, leadership, and public recognition of those who dedicate their careers to protecting public health, preserving environmental resources, and safeguarding critical water infrastructure.


The WaterHIRD community seeks to advance education through accurate information, practical learning, professional collaboration, and continuous improvement.


6.2 Educational Philosophy

WaterHIRD believes that education is most effective when it promotes understanding rather than memorization.


Accordingly, the Services are designed to explain concepts, encourage critical thinking, improve professional judgment, and increase technical competence.


WaterHIRD does not exist solely to prepare individuals to pass examinations.


Instead, our objective is to develop knowledgeable professionals capable of making informed decisions throughout their careers.


6.3 Continuous Improvement

WaterHIRD reserves the right to revise, expand, improve, reorganize, replace, discontinue, or remove educational content at any time in order to maintain accuracy, relevance, quality, technological advancement, or business objectives.


Educational materials may evolve as regulations, industry standards, scientific knowledge, technology, operational practices, and instructional methods change.


6.4 Future Growth

Users acknowledge that WaterHIRD is an evolving educational platform.


The Services may expand to include additional educational disciplines, certifications, instructors, software applications, artificial intelligence tools, marketplaces, communities, professional networking features, publications, conferences, scholarship programs, mentorship opportunities, consulting services, and other offerings without requiring amendment of this Agreement except where required by law.


ARTICLE VII

Relationship Between Waterhird And Users

7.1 Educational Relationship

The relationship between WaterHIRD and each User is solely that of an independent educational service provider and an individual choosing to utilize those educational resources.


Nothing contained within this Agreement creates a fiduciary relationship, agency relationship, employment relationship, partnership, joint venture, franchise, consulting engagement, advisory relationship, or other special legal relationship.


7.2 Independent Judgment

Users acknowledge that they remain solely responsible for exercising independent judgment when applying any information obtained through the Services.


Every workplace, utility, employer, project, jurisdiction, and regulatory environment presents unique circumstances that may require procedures different from those discussed by WaterHIRD.


Users shall independently evaluate all educational information before applying it within any real-world environment.


7.3 No Employer Authorization

WaterHIRD does not authorize any User to:


Modify operational procedures;

Deviate from employer policies;

Override supervisory direction;

Ignore manufacturer recommendations;

Bypass workplace safety requirements;

Violate permits;

Ignore regulatory obligations;

Perform work beyond their qualifications; or

Substitute WaterHIRD educational content for required employer training.

Educational content is intended solely to promote understanding and professional development.


Operational decisions remain the sole responsibility of the User and the User's employer.


7.4 Professional Responsibility

Users remain solely responsible for ensuring that their actions comply with all applicable:


Laws;

Administrative rules;

Regulatory requirements;

Professional standards;

Employer policies;

Safety procedures;

Permit conditions;

Manufacturer instructions; and

Industry best practices.

Nothing presented through WaterHIRD relieves Users of these responsibilities.


ARTICLE VIII

Educational Principles

8.1 Commitment to Education

WaterHIRD is committed to providing educational resources designed to promote understanding, critical thinking, professional development, and lifelong learning within the water, wastewater, environmental, utility, and related industries.


Our instructional methods may include written materials, videos, illustrations, animations, quizzes, flashcards, games, podcasts, discussions, simulations, webinars, downloadable resources, and other educational formats. The format of instruction may change over time as educational methods and technologies evolve.


8.2 Continuous Improvement of Educational Content

WaterHIRD continually evaluates, revises, and updates its educational materials in an effort to improve accuracy, clarity, usability, and educational value.


Educational content may be revised at any time to reflect changes in:


Industry standards;

Scientific understanding;

Operational practices;

Regulatory developments;

Technological advancements;

Instructional techniques; or

Business objectives.

Accordingly, content previously viewed by a User may differ from later versions.


8.3 Educational Independence

WaterHIRD develops educational content independently and may present information using examples, illustrations, demonstrations, opinions, or instructional techniques intended to facilitate learning.


Examples used throughout the Services are intended solely to illustrate concepts and should not be interpreted as mandatory procedures applicable to every workplace, utility, facility, employer, or jurisdiction.


8.4 No Promise of Educational Results

Every User learns differently.


Accordingly, WaterHIRD makes no representation or guarantee that any User will:


Successfully understand every topic presented;

Correctly interpret educational material;

Retain information presented through the Services;

Answer quiz or examination questions correctly;

Successfully complete any examination;

Obtain or maintain any certification or license;

Receive continuing education credit;

Improve job performance;

Obtain employment;

Receive a promotion; or

Achieve any specific educational or professional outcome.

WaterHIRD provides educational opportunities. The effort, preparation, comprehension, and performance of each User remain solely the responsibility of that User.


8.5 Independent Learning

Users acknowledge that successful learning requires personal study, practice, repetition, independent research, and continued professional development beyond the materials provided through the Services.


WaterHIRD encourages Users to consult applicable laws, regulations, employer policies, manufacturers' documentation, accepted industry standards, and qualified professionals whenever appropriate.


ARTICLE IX

General User Responsibilities

9.1 Responsible Use

Users agree to use the Services responsibly, professionally, ethically, and in accordance with this Agreement.


Users are expected to conduct themselves in a manner that contributes positively to the educational environment established by WaterHIRD.


9.2 Accuracy of Information

Users agree to provide accurate, current, and complete information when creating an account or otherwise interacting with the Services.


Users are responsible for maintaining current account information and promptly updating information that changes.


9.3 Account Security

Users are solely responsible for maintaining the confidentiality of their usernames, passwords, authentication credentials, and account access.


Users agree to notify WaterHIRD promptly if they become aware of unauthorized access to their account.


9.4 Compliance with Laws

Users agree to comply with all applicable federal, state, provincial, local, and international laws and regulations while using the Services.


Nothing within the Services should be interpreted as encouraging or authorizing unlawful conduct.


9.5 Respect for the Community

WaterHIRD seeks to foster a professional community based upon respect, collaboration, integrity, and continuous learning.


Users agree to communicate respectfully with instructors, moderators, volunteers, sponsors, contributors, and fellow Users.


Additional Community Standards and the Code of Conduct are incorporated into this Agreement and shall govern participation in interactive features of the Platform.


9.6 Future Features

Users acknowledge that WaterHIRD may introduce additional products, services, memberships, educational offerings, technologies, mobile applications, artificial intelligence features, certification programs, communities, or business initiatives.


Unless otherwise stated, those future offerings shall also be governed by this Agreement and any supplemental policies applicable to the specific feature or service.


9.7 Communications

By creating an account or otherwise providing contact information, Users consent to receive communications related to their account, purchases, subscriptions, courses, platform updates, security notifications, policy changes, customer service matters, and other operational information necessary for the administration of the Services.


Where permitted by law and subject to the preferences selected by the User, WaterHIRD may also send newsletters, educational updates, promotional announcements, and information regarding new products, services, events, or opportunities. Users may opt out of promotional communications in accordance with the WaterHIRD Privacy Policy, but transactional and account-related communications may still be sent when reasonably necessary.


PART II

Membership, Accounts, And Platform Access

ARTICLE X

User Accounts

10.1 Account Registration

Certain features of the Services require the creation of a WaterHIRD account.


By registering for an account, the User represents and warrants that all information provided during registration is accurate, current, complete, and submitted in good faith.


Users agree to promptly update account information whenever necessary to ensure its continued accuracy.


WaterHIRD reserves the right to suspend or terminate accounts containing materially false, misleading, fraudulent, or incomplete information.


10.2 One Account Per Individual

Unless expressly authorized in writing by WaterHIRD, each individual may maintain only one personal account.


Organizations purchasing educational access for employees may utilize organizational accounts or enterprise licensing only through programs expressly offered by WaterHIRD.


Users shall not create multiple accounts for the purpose of avoiding suspensions, obtaining additional free trials, manipulating leaderboards, circumventing pricing, or otherwise abusing the Services.


10.3 Account Ownership

The registered account holder remains responsible for all activity occurring under the account.


Users may not sell, assign, transfer, rent, lease, sublicense, or otherwise transfer their account or account credentials to another individual or organization without WaterHIRD's prior written authorization.


10.4 Account Security

Users are responsible for maintaining the confidentiality of usernames, passwords, authentication methods, and other security credentials.


Users agree to immediately notify WaterHIRD if they become aware of:


Unauthorized access to their account;

Loss or compromise of login credentials;

Suspected account misuse; or

Any security incident affecting their account.

WaterHIRD may require password changes or additional verification where reasonably necessary to protect account security.


10.5 Unauthorized Access

Users shall not attempt to:


Access another user's account;

Circumvent authentication systems;

Gain unauthorized administrative access;

Interfere with account security features; or

Assist another person in obtaining unauthorized access to the Services.

Such conduct may result in immediate account suspension or termination and may also violate applicable law.


ARTICLE XI

Memberships And Subscriptions

11.1 Membership Programs

WaterHIRD may offer free memberships, paid memberships, subscriptions, enterprise accounts, educational bundles, promotional access, or other participation programs.


Features and benefits may vary by membership level.


11.2 Subscription Services

Certain Services may be offered through recurring subscription plans.


By enrolling in a subscription, the User authorizes recurring charges through the selected payment method until the subscription is canceled in accordance with these Terms and the applicable billing procedures.


11.3 Automatic Renewal

Unless canceled before the beginning of the next billing cycle, subscriptions automatically renew at the then-current subscription rate.


It is the User's responsibility to manage subscription settings and cancel recurring billing before the next renewal date if continued participation is not desired.


11.4 Membership Benefits

Membership benefits may include, depending upon the applicable plan:


Access to educational courses;

Quizzes and assessments;

Digital resources;

Study guides;

Flashcards;

Educational games;

Podcasts;

Community participation;

Leaderboards;

Achievement systems;

Discounts;

Early access to content;

Exclusive events; and

Other benefits designated by WaterHIRD.

WaterHIRD may modify membership benefits from time to time as the Platform evolves.


11.5 Promotional Offers

From time to time, WaterHIRD may offer introductory pricing, promotional discounts, scholarship programs, coupons, referral incentives, bundled packages, or limited-time offers.


Unless expressly stated otherwise, promotional offers:


Have no cash value;

May not be combined;

May not be transferred;

May not be resold; and

May be modified or discontinued at WaterHIRD's discretion.

ARTICLE XII

Pricing, Billing, And Refunds

12.1 Pricing

WaterHIRD reserves the right to establish, modify, or discontinue pricing for any Service, course, subscription, membership, product, event, or educational offering.


Pricing changes shall not affect completed purchases but may apply to future transactions and renewals as permitted by applicable law.


12.2 Billing

Billing for subscriptions shall occur on the schedule selected at the time of purchase.


Users are responsible for maintaining valid payment information with the applicable payment processor.


If payment authorization fails, WaterHIRD may suspend access to paid Services until the account is brought into good standing.


12.3 Payment Processing

Payment information is processed by authorized third-party payment providers.


WaterHIRD does not store complete payment card information where payment processing is handled directly by those providers.


The use of third-party payment services remains subject to the terms and privacy policies of those providers.


12.4 Refund Policy

Because WaterHIRD provides immediate access to digital educational content upon purchase, Users acknowledge that the value of the Services begins immediately after enrollment.


Except where otherwise required by applicable law or expressly stated in writing by WaterHIRD, requests for refunds must be submitted within twenty-four (24) hours of the original purchase.


After that period, purchases of digital educational content, subscriptions, memberships, and similar Services are generally considered final.


Approval of any refund request remains subject to WaterHIRD's published refund policy and applicable law.


12.5 Taxes

Users are responsible for any taxes, duties, governmental fees, or similar charges imposed in connection with their purchases, except where WaterHIRD is required by law to collect and remit such amounts.


12.6 Chargebacks

Users are encouraged to contact WaterHIRD before initiating a payment dispute or chargeback.


WaterHIRD reserves the right to investigate disputed transactions and, where appropriate, suspend access to paid Services while a payment dispute is being resolved.


12.7 Future Pricing

As WaterHIRD expands its educational offerings and Services, pricing structures may evolve to include additional membership tiers, enterprise licensing, continuing education programs, instructor-led courses, premium content, software tools, mobile applications, or other offerings.


Future pricing changes shall not modify existing contractual rights except as permitted by this Agreement and applicable law.


ARTICLE XIII

Community Standards, Academic Integrity, and Platform Conduct

Community Standards

WaterHIRD exists to provide a positive, respectful, and professional learning environment. Every member of the WaterHIRD community is expected to contribute in a manner that promotes education, collaboration, and mutual respect.


Whether participating in a course, forum, blog, social media page, livestream, event, leaderboard, or other community feature, users are expected to conduct themselves professionally and respectfully toward fellow members, instructors, moderators, sponsors, and guests.


WaterHIRD reserves the right to remove content or restrict participation that is inconsistent with these standards.


Academic Integrity

WaterHIRD is committed to honest learning. Our educational resources are designed to help users understand concepts and develop professional knowledge.


Users are expected to complete quizzes, assessments, challenges, and other learning activities honestly.


The following activities are prohibited:


Sharing quiz or assessment answers for the purpose of helping others bypass the learning process.


Copying another person's work or presenting it as your own.


Using another person's account to complete educational activities.


Allowing another individual to complete courses or assessments on your behalf.


Misrepresenting course completion or educational achievements.


Falsifying certificates or credentials issued through WaterHIRD.


WaterHIRD encourages learning through collaboration and discussion but expects all completed work submitted for credit or recognition to represent the user's own efforts.


Fair Competition

Many WaterHIRD activities are designed to make learning enjoyable through friendly competition.


Leaderboards, achievement systems, games, challenges, and recognition programs are intended to reward participation, effort, and knowledge.


Users may not intentionally manipulate rankings or unfairly influence competition through dishonest means.


Examples of unacceptable conduct include:


Creating multiple accounts to influence rankings.


Using automated software or scripts to complete activities.


Exploiting software errors or technical issues.


Manipulating scores or participation records.


Attempting to interfere with another user's participation.


If irregular activity is identified, WaterHIRD may review the results and, where appropriate, remove scores, achievements, or rankings in order to preserve the integrity of the educational experience.


Artificial Intelligence and Automated Tools

WaterHIRD recognizes that artificial intelligence is becoming an important educational resource. Users are welcome to use AI responsibly to assist with learning, research, and understanding concepts.


However, users may not use automated systems to:


Circumvent educational activities.


Generate fraudulent assessment results.


Access restricted areas of the platform.


Harvest user information.


Copy or systematically collect WaterHIRD content.


Create competing educational products using WaterHIRD materials.


Our goal is to encourage learning while protecting the integrity of the educational experience and the original work created by WaterHIRD.


Respect for Intellectual Property

Users should respect the work of instructors, contributors, and fellow members.


Please do not upload or share copyrighted material unless you have permission to do so.


Likewise, please do not post confidential employer information, proprietary operating procedures, sensitive security information, or material that you do not have the legal right to share.


User Contributions

WaterHIRD welcomes thoughtful discussion, constructive feedback, questions, photographs, videos, stories, and other contributions that benefit the community.


By voluntarily submitting content through WaterHIRD platforms, users acknowledge that WaterHIRD may display, share, or feature that content in connection with operating and promoting the community and its educational mission, consistent with our Privacy Policy and any permissions granted by the user.


Whenever practical, WaterHIRD will make reasonable efforts to credit the original contributor.


Reporting Concerns

If you believe another user has violated these Terms, is engaging in inappropriate conduct, or has posted content that may be inaccurate, offensive, or unlawful, we encourage you to report the matter to WaterHIRD.


Reports will be reviewed as reasonably practicable. WaterHIRD may investigate reported concerns and take appropriate action to help maintain a safe, respectful, and productive learning environment.


Enforcement

WaterHIRD may respond to violations of these Terms or Community Standards in a manner appropriate to the circumstances.


Depending on the nature and severity of the conduct, responses may include:


Educational guidance or a warning.


Removal of content.


Temporary suspension of community features.


Removal from leaderboards or competitions.


Suspension or termination of platform access.


Restriction of future participation in WaterHIRD programs or events.
